Our Website, www.napoleao.eu or  www.napoleao.co.pt shall not collect, automatically, any Personal data from any user, who has not registered or entered freely their emails for newsletter receiving purposes.

This Privacy Policy regulates the collection and processing of Personal Data supplied by the user / costumer at our website, www.napoleao.eu or www.napoleao.co.pt ,  as well as at any of our physical stores the practice of the rights established by the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC).

Personal Data (definition)

We do not automatically collect any Personal sensitive data. When any Personal data is supplied, whether under legal obligation or willingly by the user / costumer, we will assume total and complete explicit consent to process that information in the scope of the purpose for which that Personal data was supplied.

Liability

NAPOLEAO - Wine Shops & Gourmet is responsible for collecting and processing the Personal data explicitly supplied by the users and costumers of our Web Store www.napoleao.eu or www.napoleao.co.pt and physical stores. We shall decide which data to collect, how to process it as well as the purpose of the data usage.

No Personal Data information shall be shared, sold, supplied or given to third parties unless there is legal obligation to do so or it is mandatory in order to meet the purpose of the commercial relationship between NAPOLEAO - Wine Shops & Gourmet and user / costumer (eg.: Shipping Partner). All Personal data collected is of the exclusive use of  NAPOLEAO - Wine Shops & Gourmet, in the scope of our regular commercial activity.

Collected Personal Data - With What Purpose and Which Kind:

NAPOLEAO - Wine Shops & Gourmet will collect and process all necessary Personal data from or users/costumers for the purpose of:

• Managing, processing and delivery of products and services ordered and purchased by our users / costumers, in our physical  stores as well as in our Web Store.
• Communicating with the user / costumers in relation to requests, inquiries, complaints, statistics analysis and marketing.

The Personal Data collected from the user, with his/her explicit consent: name, billing and/or delivery address, county, zip code, country, telephone number, cell phone, fiscal number, email address.

Any collected Personal data will be processed manually as well as digitally and according to the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC). All the Personal Data shall be stored in specific user / costumer related data bases, guaranteeing safeness and confidentiality, using secure and reliable technological, technical and institutional information means, so that the user shall be protected from loss, modification, destruction and usage of the collected Personal data for any other purpose, then of that consented by the owner of that Personal data.  

 If you wish to subscribe our email Newsletter or want to make us an enquiry through the "contact us" section, you will be presented with a Personal data collection form. Should you decide to submit any of the available forms with your Personal data, for such purposes, we shall consider it, as a total and complete voluntary consent for the enabling and usage of Personal Data submitted.

Once in a while, NAPOLEAO - Wine Shops & Gourmet may use the supplied Personal Data to: contact users / costumers with considered relevant information. The users / costumers may, at any time, forbid the reception of information from our end.

All Personal Data collected will be exclusively used by NAPOLEAO - Wine Shops & Gourmet. NAPOLEAO - Wine Shops & Gourmet, that might also use the collected Personal Data for marketing needs, statistics, analysis of trends and measurements for optimization of commercial campaigns and other marketing purposes, promotional or business analysis. All the use will be internally done, none of this information will be shared, sold or released to Third Parties, unless legally required or this is mandatory in order to meet the purpose of the commercial relation between NAPOLEAO - Wine Shops & Gourmet  and user /costumer. Although NAPOLEAO - Wine Shops & Gourmet  and our business partners use strick safety measures to protect the Personal data collected and processed, the users / costumers should use additional security measures such as: updated and secured Browsers, active firewall, anti-virus, anti-spyware and only navigate through trusted websites, avoiding suspicious websites.

Holding Time, Process, Update, Rectification, Access Copy, Portability, Limitation, Opposition and Removal of Personal Data

The holding time of the collected Personal data will vary according to the purpose for which the Personal data was originally supplied. The holding time of the Personal data will also vary according to the legal requirements that may demand a minimum holding period of time. When there is no legal issue, the holding time of the Personal data will be the minimum possible time, according to the purpose of the Personal data collection, being erased once the purpose has ended.  

Any Personal data owner has the right to Update, Rectify, Access a copy, Oppose to marketing purposes or other valid purposes, request the removal of the collected / processed / used Personal data.

Any request for  Process, Update, Rectification, Access Copy, Portability, Limitation, Opposition and Removal of Personal Data may be requested by the user / costumer / owner of that Personal data, through direct contact with NAPOLEAO - Wine Shops & Gourmet. This request should be submitted to the email: gdpr@napoleao.eu , under the subject in question. We shall answer and comply within a few days, unless there are forbidding Legal Requirements. (egg.: Personal data of a Fiscal Invoice, there is a minimum holding time legal requirement)

Any user / costumer / owner of the Personal data may also make a claim to the CNPD.

When Where will Personal Data be collected

The Personal Data collected by NAPOLEAO - Wine Shops Gourmet will be collected when:

• When a user / costumer orders products to be delivered at his/her address, from any of our physical stores or from our Web Store, www.napoleao.eu or www.napoleao.co.pt.
• When a user / costumer registers in our Web Store, www.napoleao.eu or www.napoleao.co.pt .
• When a user / costumer submits his/her email address for Newsletter reception from NAPOLEAO - Wine Shops & Gourmet .
• When a user / costumers visits any of our physical stores and makes a purchase demanding an invoice with his/hers Personal Data for whatever purposes.
• When a user / costumers supplies Personal Data for further information about products, services from NAPOLEAO - Wine Shops & Gourmet. These information may be given by phone, letter or email.

Reception of Marketing Communications

NAPOLEAO - Wine Shops & Gourmet will eventually, but seldom, send email Newsletters, using Personal data, except if the Personal Data owner is explicitly against it. Any user / costumer may oppose the reception of Marketing communication from NAPOLEAO - Wine Shops & Gourmet at any time, using the gdpr@napoleao.eu email to do so. All emails Newsletters will have an unsubscribe link available, that allows users / costumers to unsubscribe and be removed from our Mailing List.

Personal Data Communication to Third Parties

NAPOLEAO - Wine Shops & Gourmet will in the scope of it's commercial activity use the Personal data collect. None of the Personal data collected will be shared, sold or released to third parties, unless legally required or it is mandatory in order to meet the purpose of the commercial relation between NAPOLEAO - Wine Shops & Gourmet  and user /costumer. (eg.: Shipping Partner).

The Third Parties with whom, to meet the purpose of the commercial relation between user / costumer and NAPOLEAO - Wine Shops & Gourmet, is shared collected Personal data from users / costumers, will have a contractual relation with us, that obliges that all the shared Personal data shall be processed with care, not being shared, sold or released to other, unless legally required or to meet the purpose of our commercial relation with our costumer and in accordance with our Privacy Policy and GDPR section. (egg.: a shipping partner from our Shipping partner) Any Third Parties will also obey the GDPR (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC).

Cookies can be used to record the number of visits to our website, different website pages for general statics, they will not identify users. The cookies may also be used to customize a user / costumer visit to our Web Store, www.napoleao.eu or www.napoleao.co.pt. Nevertheless the Cookies may be erased at any moment by the user, for such can be done willingly using browser definitions / history section. The type of Cookies used will not collect any Personal data. NAPOLEAO - Wine Shops & Gourmet does not use Third Parties cookies.

Our Privacy Policy may be readjust at any time without previous notice, although complying with the Legal Regulations adopted by the Portuguese Republic. Any change to our Privacy Policy will be published in our website, under this section.
